Terms & Conditions – Sierra Villas

Contracting Parties

Definitions:“Guest” means any person who has made a reservation or occupies the property. “Provider” means the registered provider listed above.These terms apply to all guests (including their companions) during their stay.

Reservation and Payment

  • Minimum stay: 6 nights
  • Payment terms:
    • 25% deposit of the total price to confirm the reservation
    • 75% balance payable no later than 56 days before arrival
  • Notice: If the balance is not paid on time, the reservation may be cancelled and the deposit retained as a contractual penalty. By making any payment, the Guest confirms acceptance of these terms and the cancellation policy.
  • Administrative fee: In case of cancellation, a non-refundable fee of €50 applies.
  • Travel insurance: The Provider recommends that all clients take out comprehensive travel insurance to cover possible cancellation. If you choose not to obtain insurance, you accept responsibility for any loss arising from cancellation.

Restrictions and Age Limits

  • Age restriction: Reservations will not be accepted from persons under 18 years of age. For group bookings where the average age is below 28, prior written approval is required and an additional security deposit may be imposed.
  • Capacity and occupancy: The maximum number of persons must not exceed the limit specified for the accommodation. Only persons listed in the reservation form are permitted to occupy the property. Violation of this rule may result in immediate termination of the stay without compensation.
  • Subletting prohibition: The Guest is not permitted under any circumstances to rent out or sublet the property, even free of charge.

Cancellation Policy

Cancellation fees are applied based on the time of cancellation prior to arrival:

  • Proportionality principle: If the Provider rebooks the dates, the Guest will receive a proportional refund of the amount paid (after deduction of a €50 fee).
  • Shortened stay: In case of early departure after check-in, no refund will be provided for unused nights.

Security Deposit

  • Amount: €750 (payable in cash or by transfer upon arrival)
  • Purpose: To cover damages to the property, loss of keys/remotes, excessive cleaning (e.g. indoor smoking), or breach of rules.
  • Damages: The Guest is responsible for all damages. Any damage or missing equipment must be reported immediately upon discovery.
  • Cleaning: If the property is left in an unacceptable condition, an additional cleaning fee will be charged. Upon departure, all waste must be removed and food leftovers disposed of.
  • Refund: The deposit will be returned within 14 days (maximum 30 days as per law) after inspection of the property and deduction of documented costs.

Check-in / Check-out and Registration

  • Check-in:
    • 15:00–17:00: free of charge
    • 17:00–20:00: €30
    • After 20:00: €50
    • After 22:00: €75 (only with prior written agreement)
  • Check-out: by 11:00
    • Late check-out (until 14:00): €50 (non-refundable for that day)
  • Legal requirement: Guests must present identification for registration with the Guardia Civil (RD 933/2021). Personal data is processed in accordance with GDPR.
  • Keys:
    • Lost keys: €50
    • Staff call-out due to lockout caused by negligence: €30

House Rules

  • Strictly prohibited: Pets, parties/events, smoking indoors
  • Additional prohibitions: Pets, parties, smoking, vaping, and use of candles inside the property are strictly forbidden. Violation will result in immediate termination of the stay and forfeiture of all payments.
  • Quiet hours: Guests must maintain minimal noise levels, especially between 23:00 and 08:00.
  • Right of access: The Provider or their representatives may enter the property at any time for necessary maintenance or inspection.
  • Maintenance: Pools and gardens are maintained regularly. The Provider is not responsible for construction activities nearby or temporary outages of public services (water, electricity, internet, TV signal).
  • Children: Parents are fully responsible for the safety of their children.

Force Majeure

In the event of circumstances beyond the Provider’s control (natural disasters, epidemics, government restrictions), the Provider shall not be liable for failure to perform obligations. The Guest is not entitled to compensation unless an alternative date or credit is offered.

Liability and Deposit Use

The Guest is responsible for all damages caused by themselves or persons they have accommodated. By paying the security deposit, the Guest automatically agrees that the Provider may use part or all of the deposit to cover such damages. The Guest will be informed in advance of any deductions.

Complaints

  • Any issue must be reported immediately. Complaints reported only after the end of the stay will not be considered. If the matter is not resolved on-site, it must be submitted in writing within 14 days after return.
  • These terms are governed by Spanish law. The Provider reserves the right to make reasonable changes to these terms without prior notice.

Consumer Rights and Governing Law

These terms are governed by Spanish (Andalusian) law and consumer protection law (RDL 1/2007). Any disputes shall be resolved by the competent courts in Andalusia.

Agreement

By making a reservation or payment, the Guest confirms full acceptance of these terms and conditions.

Consent to the Processing of Personal Data for Marketing Purposes

By submitting an order, you agree to the processing of personal data and to receiving marketing materials. This consent may be withdrawn at any time.

Data Controller: The accommodation provider operating this reservation service.

Data Processor: The entity managing the reservation system and processing customer data.

Data Subject: A natural person who has provided personal data through a reservation or consent.

Scope of Personal Data Processing

The controller processes personal data including: name, surname, date of birth, address, identification details, payment card number, email, phone number, and signature.

Purpose of Data Processing

Personal data is processed for the purpose of fulfilling contractual obligations, legal requirements, and marketing activities (including sending commercial communications).

Legal Basis for Processing

The legal basis for processing is the data subject’s consent, legitimate interest of the controller, performance of a contract, or compliance with legal obligations.

Data Retention Period

Personal data is retained for the duration of the contractual relationship and subsequently for up to 10 years in accordance with legal requirements.

Withdrawal of Consent

Consent to the processing of personal data may be withdrawn at any time free of charge. Withdrawal does not affect the legality of processing prior to withdrawal.

Access to Personal Data
